Lincoln’s requirements

What Lincoln requires

Lincoln passed By-law 2025-40, its Private Property Tree By-law, in September 2025. For construction:

  • Barrier: retained trees covered by a Tree Protection Plan must be protected with barriers or hoarding, built to the plan.
  • Development sites: the Town’s Tree Protection and Enhancement Policy requires preserved trees to be fenced to the Town’s Tree Protection Zone standard detail.
  • Permit sign: a tree permit must be posted securely on the property, visible from the street, at least two days before removal starts, and kept up during and after the work.
  • Inspections: the permit holder requests inspections at the start and completion of work.
  • Three or more trees: a permit application needs a Tree Preservation Plan and a replacement or landscape plan.
Which trees are protected?

Protected trees

  • Public trees: any size.
  • Private trees in the Urban Area: 15 cm DBH and larger.
  • Any size: in Natural Environment Areas, heritage trees, trees in a Tree Preservation Plan, and trees on sites with a current or recent planning application.

FAQ

Lincoln FAQ

Which private trees need a permit in Lincoln?

In the Urban Area, trees 15 cm DBH and larger. In Natural Environment Areas, any size.

What are the penalties?

Court fines for individuals start at up to $10,000 or $1,000 per tree, whichever is greater, and are higher for corporations and repeat offences.

Do you build to the arborist report?

Yes. We build what the arborist report states: the protection zones, the barrier type and any extra measures it calls for. Where the report asks for more than the City minimum, we build to the report.

Can you recommend an arborist?

Yes. If your permit needs an arborist report or Tree Protection Plan and you don’t have one yet, tell us when you get in touch and we’ll recommend an arborist.
